One-Year Guarantee

BeagleStore.com on behalf of Breeder and Buyer:

Stipulations of Guarantee:

1. Purchaser is required to have the puppy examined by a licensed veterinarian within two (2) days of delivery in order for guarantee to begin to be in effect. If indicated, Buyer will provide his/her veterinarian with the health certificate issued by the Breeder's veterinarian no more than seven (7) days prior to shipment or, in the event the Buyer picked up the puppy from the Breeder, to date of Buyer taking possession of the puppy.

2. If, at the time of the initial examination, the buyer's veterinarian indicates that such animal appears to have an active illness or disease, Buyer is required to contact the Breeder within 48 hours of said examination to advise of buyer's veterinarian's report, and a copy of same will be faxed to dogbreedersdirect and to the Breeder.
    Breeder will provide Buyer with name and phone number of veterinarian who issued health certificate, and Buyer will provide his/her veterinarian with this contact information. Buyer's veterinarian will initiate contact with Breeder's veterinarian to discuss and resolve any health concerns he/she believes to be at issue. If indicated, Breeder's veterinarian may provide Buyer's veterinarian with any test results in support of his/her decision to certify the puppy as healthy.
   Veterinarians will provide a collaborative report to the Buyer, the Breeder and BeagleStore.com. Any resolution will be arrived at based upon the findings presented in the veterinarians' collaborative report, whether in favor of the Buyer or the Breeder, at the discretion of management.

3. If, within one (1) year from the date of  birth only, a dog is certified by a licensed veterinarian to have any congenital or hereditary disorder which adversely affects the animal, Buyer is required to contact the Breeder within 48 hours of said examination to serve notice of buyer's veterinarian's report. The Breeder will be responsible for providing a replacement puppy of equivalent value. However, Breeder will not be responsible for any veterinarian's fees or costs related to such examination(s).
    If indicated, Buyer will return the animal to the Breeder to exchange for another dog of equivalent value.

4. Neither BeagleStore.com nor the Breeder makes any guarantee as to the breeding or show capabilities of the animal, and same will not be held liable for any failure in attempts at breeding or showing. Breeder sells puppies for companion purposes; any other use of dog by Buyer is not covered in any way by this guarantee.

5. In the event of any legal actions arising from or in connection with this guarantee, the Breeder will be paid reasonable attorney fees by the Buyer. Jurisdiction and/or venue of any litigation arising out of or related to this contract shall lie exclusively in the county and state in which the Breeder operated his/her breeding business at the time of purchase.

Paperwork and/or documentation for registration of all registered puppies will be sent by regular mail. The Breeder is not required to provide registration for any puppy and, if Breeder does not elect to do so, registration and costs of obtaining new papers will be the responsibility of the Buyer. However, we will assist the Buyer in any other reasonable manner in obtaining these papers.

Limitations of Guarantee:

This guarantee is not transferable to any other individual, group, organization or entity. Dog must be properly cared for and nourished, and all vaccinations must be kept current in order to maintain effect of this guarantee. No replacement will be provided if a female has been bred. No replacement will be provided after registration application has expired. No replacement will be provided for reasons of hip dysplasia if dog is not properly nourished, exercised, or if dog is permitted to become overweight. (Buyer must follow Breeder recommendations, including recommended dog food(s), vitamin and mineral supplement administration.) No replacement will be given if dog is over-exercised, which will be construed to include: excessive running, overworking or jumping the dog. (Purchaser must be aware that running on asphalt or concrete can seriously damage the young bones and joints of a puppy and in such a case, the guarantee is null and void.)

All above-mentioned conditions must be met or guarantee will be considered null and void in all parts thereof. All laboratory verification will be performed by a licensed veterinarian. The Buyer is responsible for transportation costs to and from Breeder. Breeder is not responsible for any veterinarian expenses incurred and accumulated by Buyer on returned or replaced puppy or dog.

I, the undersigned Buyer of a puppy from said Breeder, hereby acknowledge that I have received this document, as well as my pet's state health certification signed by a licensed veterinarian as pertains to the genetic and hereditary health of my pet, good for one (1) year from the date below. I further accept the terms and conditions of this guarantee as stated above and hereby relinquish any and all other rights that I may otherwise have, should any event occur to necessitate the execution of this guarantee. Buyer acknowledges by signing below that he or she understands and agrees to all terms and conditions of this document.

REFUNDS

Security Deposits:
It is the intent of BeagleStore.com to provide the buyer with a Beagle that meets the buyer's specified criteria with regard to demeanor, gender, color, size, etc. Therefore, photographs of puppies currently posted for sale are posted on our website from which the buyer will select the puppy of their choice. If the selected puppy is too young to be shipped at the time the buyer chooses him/her, a deposit can be collected to reserve the puppy for the buyer. This deposit is NON-REFUNDABLE. If the buyer changes his/her mind, the deposit can be applied to the purchase of another puppy, but in no case will the deposit be refunded.

The deposit has been paid to the breeder as good faith money to secure the puppy for the buyer from being purchased by any other individual. As a result of removing the puppy from available stock, the breeder is rejecting other viable offers on the basis of the good faith deposit and is therefore disadvantaged if the buyer reneges on purchasing the puppy.  Only if there occurs an unforeseen health complication with the puppy will any deposit be refunded, and then only after searching for a replacement puppy and only at the discretion of management.

Management will send approval of refund via e-mail to buyer. All refunds of any kind will be issued in thesame form as the funds were received - issued within 4 weeks from date of management's approval of refund.
